Looking for a home on the Treasure Coast certainly offers so many wonderful options. While it is exciting to buy a home, it can also be stressful and intimidating. This can be especially so if you are relocating from another state. Working with a trusted real estate broker who lives in and knows the region and current real estate market can make the process easier and much more efficient. In this month’s article, I will offer some suggestions and tips for buyers.
Retaining a buyer’s broker who is both your advocate and who is legally obligated to prioritize your interests is my recommended first step to start your search. While many real estate professionals work as a “transactional” broker, buyers need to know that transactional brokers do not owe the same duty to you as a buyer’s agent does. In Florida, if an agent represents both parties to a sale, they are only in a “transactional” role with no fiduciary or loyalty duty to either side.
For example, a buyer’s broker legally and ethically owes you full loyalty and strict confidentiality.Unlike a listing or transactional agent whose primary duty is to the seller or to the “deal”, a buyer’s broker has an actual fiduciary duty to the buyer. In other words, your buyer’s broker must keep your information confidential and work to get you the best price and terms.
Traditionally, sellers have covered the fees of the buyer’s broker; however, as of August 2024, the rules have changed a bit. When you interview a buyer’s broker, they should fully disclose how they will be paid and a written agreement should be signed before you tour any homes. Many sellers are still offering compensation for the buyer’s broker, but it is no longer guaranteed.
In the buyer’s broker’s agreement, the new rules require how compensation will be managed. The fee and the amount are now subject to negotiation. A good broker will answer all of your questions promptly and clearly. If you are not comfortable with their answers, do not sign any agreement. It is better to take more time and find that broker who you can trust.
Once you find the right person to be your buyer’s broker, in addition to showing you properties and helping prepare the related contracts, below are a number of ways a buyer’s broker can assist you:
- Market Analysis: Brokers use comparable sales to help you evaluate the price of a given home before you make any offer. This way you can spot an overpriced home and leverage inspection results to negotiate repairs or price credits.
- Paperwork & Deadlines: Buying a home involves a number of steps in the process and legal documents with strict timelines. A broker manages these to ensure nothing is missed, which is key in protecting your downpayment deposit.
- Team of Experts: A good local buyer’s broker has a network of lenders, inspectors, and contractors who are known in the area for being dependable.
- Review Seller Disclosures: In Florida, the buyer can ask the seller to complete a Seller’s Disclosure. This is a key form to obtain and check for known defects in the home and land before you make any offer.
- HOA Details: Florida HOAs have common state laws, but many have unique “quirks.” Beyond strict lifestyle rules on pets and rentals, their financial health is also vital. Low reserves often trigger massive special assessments or loan denials. Because they can legally foreclose on your home for unpaid dues, verifying their stability is a crucial step in the process before buying. A buyer’s broker can obtain the documents and review them with you.
- Home Inspections: Beyond a standard home inspection, a buyer’s broker will advise on other key inspections to Florida, such as wind mitigation and 4-point inspections. These are unique to Florida and necessary for obtaining competitively priced homeowners’ insurance.
- Reviewing Flood Zones: Researching property for flood zone issues at the right time in the process is key to avoiding insurance premiums or building restrictions that may be unacceptable to you.
